What Is Mortgage ILA in Ontario?

Mortgage Independent Legal Advice (ILA) is a legal service required by many Ontario lenders before a mortgage or refinancing transaction can close. It is most commonly required when a non-title spouse or family member is being asked to sign a mortgage document, or when an individual is providing a personal guarantee in connection with a property transaction.

When a lender requires ILA, they are asking that you have a lawyer — one who represents you exclusively and independently of the lender and the borrower — review the mortgage documents with you, explain your legal obligations, and certify in writing that you understood what you were signing.

The resulting document is called an ILA certificate or ILA letter. Your lender will typically include it as a condition of closing. Without it, your transaction may be delayed or unable to proceed.

When Do Lenders Require Mortgage ILA in Ontario?

Ontario lenders — including major banks, credit unions, and private mortgage lenders — typically require ILA in the following situations:

  • Non-title spouse signing consent: If one spouse is on the mortgage but not on title, or vice versa, lenders often require the non-title spouse to obtain ILA before signing the mortgage or consent documents.
  • Personal guarantees on mortgages: Business owners or family members guaranteeing a corporate or personal mortgage may be required to obtain ILA to confirm they understand their personal liability.
  • Refinancing with a new guarantor: When a refinance adds or changes a guarantor, lenders may require that new party to obtain ILA.
  • Home equity lines of credit (HELOCs): Some HELOC products require ILA from all signing parties, particularly if there is a discrepancy in title ownership.
  • Second mortgages and private loans: Private lenders and mortgage investment corporations routinely require ILA as a condition of funding.

The Mortgage ILA Process at Solvine Law

Mortgage ILA vs. Full Mortgage Legal Representation

It is important to understand the distinction between mortgage ILA and full legal representation for a property purchase or mortgage transaction.

Your real estate lawyer handles the conveyancing, title search, title insurance, closing procedures, and the registration of the mortgage on title. They represent either you or the lender in the transaction itself.

Your ILA lawyer serves a narrower, specific purpose: to review a particular document with you, confirm you understand it, and issue an ILA certificate. Solvine Law provides this ILA service independently — we are not involved in the closing of your real estate transaction.

If your real estate lawyer's firm cannot provide ILA because of a conflict of interest (for example, if they are also acting for the lender or another party), Solvine Law can step in to provide the ILA portion only, allowing your transaction to close on schedule.
